Legal advice says Ten-T route selection is not a matter for councillors

Donegal County Council has been told that the adoption of preferred routes on the Ten-T network is an Executive Function, meaning it is a matter for officials and not members to decide.

After the issue was deferred last week, councillors were to have signed off on the preferred routes at a reconvened meeting this afternoon, but legal advice received by the members said it was in fact a reserved function.

This means officials will continue pursuing their preferred routes, which will then come before the new council in a number of months time as part of a review of the County Development Plan, which will have to be amended to include the route designations.

Cllr Ciaran Brogan says that's when members will have their say.............
