Circuit Court orders immediate return of money as Elvin sentencing is adjourned

Donegal Circuit Court has today ordered the immediate return of money frozen in an Ulster Bank account to its rightful owner, Sharman Duncan.
Judge John O’Hagan said €32,606 held in an account by Thomas Elvin was the property of Ms Duncan after prosecutor Patricia McLaughlin said there was no dispute about its ownership following Elvin’s fraud conviction last December.
Yesterday, the District Court in Donegal ordered the return of the money but put a stay of a month, pending a sentencing hearing in the Circuit Court.
When 51-year-old Elvin appeared for sentence today, it was put back to Carrick-on-Shannon on July 3rd because probation reports are still being prepared. He was remanded on continuing bail.
