Book of evidence served in Clonmany crash case

The driver of one of the cars involved in a crash near Clonmany in which eight men were killed has been remanded on continuing bail following a hearing at Buncrana District court today.
23-year-old Shaun Kelly, from Hillroad, Ballymagan, Buncrana, had been charged with causing the death of the seven passengers travelling in his car and another man, Hugh Friel on 11th July 2010.
Sergeant Carol Doherty told the court she served the book of evidence on Kelly outside the courthouse in Buncrana at 10.28am this morning.
Speaking in Buncrana District Court, Inspector David Murphy said the DPP had indicated that Kelly be sent forward to trial at the next criminal sitting of Letterkenny Circuit Court on 1st May.
However defence solicitor Ciaran MacLochlainn said he required two exhibits from the book of evidence, including a video of the scene of the accident and original photographs.
He said these pieces of evidence are vital for the defence and asked Judge Paul Kelly if he would postpone the trial until he received the exhibits.
After consulting with the state prosecutors office, Garda Insp Murphy agreed to a further adjournment of one month.
Judge Kelly put the case back to 8th March next and released Kelly on his continuing bail bond.
